Surrogacy Laws in Utah

Utah allows surrogacy agreements but imposes specific legal requirements to ensure compliance. Intended parents and surrogates must meet eligibility criteria, including residency requirements for at least 90 days before filing. Surrogacy contracts must be validated by a court before any medical procedures begin. Gestational surrogacy is permitted, but traditional surrogacy (where the surrogate uses her own egg) is generally discouraged and lacks the same legal protections.

The intended parents must include at least one individual who is genetically related to the child. Same-sex couples and single individuals can pursue surrogacy in Utah, but legal counsel is essential to navigate potential complexities in establishing parental rights. Post-birth, the court issues an order confirming parentage, which facilitates the issuance of the birth certificate. Because surrogacy laws in Utah are precise and detailed, working with experienced legal and fertility professionals is critical to ensure a smooth process for all parties involved.

GC Step 1. Application & Screening
Surrogate applicants complete a detailed application and undergo medical and psychological evaluations to ensure eligibility for the program.
IP Step 1. Initial Consultation
Intended parents begin with an in-depth consultation to outline their vision and learn about the surrogacy process.
GC Step 2. Profile Creation
Surrogates craft profiles highlighting their personal story, experiences, and motivations, which are shared with potential intended parents.
IP Step 2. Seeking a Surrogate
Intended parents review surrogate profiles and compare them against their specified preferences, values, and lifestyles.
Step 3. Making a Match
Once intended parents have landed on a potential candidate, we’ll facilitate an in-person meeting so all parties can get to know one another and discuss expectations.
Step 4. Legal Contracts
The intended parents will work with their attorney to draft a surrogacy contract, which the surrogate will then review carefully with her own attorney so they can request changes or get clarification on anything that may be unclear to them.
Step. 5 Medical Procedures
Once the contract is agreed upon and signed, the surrogate can begin the initial medical procedures to prepare her body for pregnancy, starting with hormone treatments. After this, a fertility doctor will complete the embryo transfer. This is a quick, easy procedure.
Step 6. Prenatal Care
Twelve to 14 days after the embryo transfer, the surrogate will have a blood test to see if she’s pregnant. Once she is, she’ll continue taking fertility medications for eight weeks, after which she can begin seeing an OB/GYN of her choice. She’ll also choose the hospital in which she’ll give birth, and will continue to be supported by medical professionals and the caring team at GSHC.
Step 7. Birth
When the surrogate goes into labor, the intended parents usually come to the hospital to provide some support. Legal documents are prepared to establish parental rights immediately after birth.
Step 8. Parental Rights & Post-Delivery Support
When the baby is born, the surrogate will have a little time to hold the baby before saying goodbye to the intended parents, who will take their new baby home with them. The surrogate will receive medical care after birth before going home to rest and recover.
Step 9. An Exciting New Chapter
The final step marks the beginning of a new chapter for the intended parents as they welcome their baby into their lives.

Surrogacy in Utah FAQ

Standard surrogacy requirements are set forth by state law to protect the health and safety of all involved parties, but different agencies may have slightly different criteria. Anyone interested in becoming a surrogate should review the guidelines carefully before submitting an application.

Some of our key requirements at GSHC include:

  • Age 21–38
  • Have given birth to at least one child you’re raising
  • No more than five previous pregnancies
  • No more than three previous C-sections
  • Good overall health, no smoking or drug use
  • Healthy BMI (31 or less)
  • No communicable diseases
  • Stable housing and home life
  • Financial stability, no government assistance

The matching process is a key component in the surrogacy journey, helping to ensure a fulfilling experience at every step. We thoroughly review all surrogate profiles, which typically include their qualifications, interests and hobbies, lifestyle, and more. We’ll then compare these profiles to the intended parents’ specified preferences, values, and lifestyles to identify potential pairings. Intended parents will be able to review these surrogate profiles and identify anyone they want to meet and get to know better. If everyone feels comfortable and confident with the arrangement, legal processes can begin.

Surrogacy costs can vary widely depending on the specifics of the arrangement, but in general, most intended parents should plan for at least $144,000 total. This includes surrogacy base pay and other compensation, legal fees, surrogate reimbursement for insurance and prescription premiums, and more. The total cost can also be affected by the surrogate’s prior experience, whether you use an egg donor, and which state your surrogate lives in.
At GSHC, we work with gestational surrogates only, meaning the surrogates are not genetically related to the baby, as they do not use their own eggs. Traditional surrogates, on the other hand, are genetically related to the baby because they use their own eggs. Due to the legally and emotionally complex nature of this type of surrogacy, it is much less common and usually not recommended.
Under Utah law, surrogacy is legal only for married couples, whether heterosexual or LGBTQ+. In most cases, single and unmarried couples looking to pursue surrogacy in Salt Lake City or throughout Utah will instead need to complete an adoption after birth and should speak with an attorney specializing in surrogacy to go over their options and decide the best way forward.
